Daniel Seabolt

• Represented a multinational construction management firm in delay and scope change claims in the construction of a portion of the Westside extension of the Los Angeles Metro Rail.
• Won a new multiyear contract, worth several hundred million dollars per year, as part of a settlement on behalf of a client contracting with the California’s Department of Health Care Services for a statewide procurement award.
• Represented a multinational owner in the prosecution of counterclaims against a contractor for scope changes and delay damages related to construction of a pea isolate processing plant located in South Sioux City, NE.
• Counseling a luxury residential developer on projects located in various cities around the country, including Atlanta, Boston, San Diego, Oakland, CA, and Oceanside, CA.
• Representing a manufacturer of glass, automotive, and building products in an indemnity claim for alleged manufacturing defects in a product provided for use in a mixed-use office space that involved three other subcontractors.
• Represented a residential property owner in a multimillion-dollar latent construction defect case, resulting in a seven-figure settlement on the eve of trial.
• Represented several clients in the removal of improperly recorded mechanics liens by way of negotiation and/or by direct challenge in court.
• Represented a low-income, elderly residential property owner in a case brought by an unlicensed contractor, which involved a fraudulently procured home-improvement contract and financial elder abuse, resulting in a total dismissal of all claims against the client.
• Represented a client in the appeal of improperly awarded default damages to the California Court of Appeal and the California Supreme Court, resulting in the reversal of the default judgment.
• Represented a client in settlement negotiations between the trustee and former beneficiary, in a matter involving disputed ownership claims to real property, resulting in the client’s retention of full ownership of the real property.
• Represented clients at trial in matters involving trust disputes, contract disputes, and unlawful detainers.

Daniel Seabolt plays a pivotal role in Alston & Bird’s nationally ranked Construction & Government Contracts Group. Daniel’s experience includes components of both transactions and dispute resolution, as well as government contract procurements and protests. Daniel is equally adept at handling non-construction litigation matters, having represented clients in a myriad of commercial litigation disputes, including cases involving fraud, negligence, intellectual property infringement, real property disputes, and other business torts.

Daniel has negotiated settlements for clients facing a myriad of claims and disputes, from matters involving simple mechanics liens and failure to pay to more complex matters involving design errors, construction defects, and construction delays. He has experience in all phases of litigation, from inception of the dispute through trial and appeal, including up to the California Supreme Court. In law school, he was a judicial extern to the Hon. Barry Russell of the U.S. Bankruptcy Court for the Central District of California.
