Financial Services Litigation
- Representing a national mortgage originator in False Claims Act litigation brought by the Department of Justice (DOJ) seeking more than $200 million. Obtained partial summary judgment, which barred the DOJ from recovering actual and treble damages under the False Claims Act.
- Representing trustees of Delaware Statutory Trust in a $40 million breach of contract and fraud case pending in the Southern District of New York. Argued motion to dismiss and obtained dismissal of derivative claims against the trust and the indenture trustee.
- Representing the administrator of $12 billion student loan securitizations in multiple litigation matters and Consumer Financial Protection Bureau (CFPB) regulatory proceedings.
- Represented a regional bank in a putative Texas state court class action related to overdraft fees. Won summary judgment on all claims.
- Represented a national mortgage originator against claims alleging violations of federal and state reverse mortgage regulations. Obtained full dismissal of all claims and affirmance by the Fifth Circuit.
- Represented multiple banking executives in claims asserted against each individually in connection with a fraud perpetrated by a series of related car dealerships.
- Represented multiple clients in the auto finance, consumer finance, and debt collection spaces in responding to examinations by the CFPB, New York Department of Financial Services, and other regulatory agencies.
- Represented some of the largest residential mortgage-backed securities (RMBS) and corporate trustees in various investor disputes and commercial litigation matters in New York, Minnesota, Delaware, and other jurisdictions.
Appellate Matters
- Argued and prevailed before the Texas Supreme Court on behalf of a Massachusetts resident challenging a protective order on territorial jurisdiction and personal jurisdiction grounds. Goldstein v. Sabatino, 690 S.W.3d 287 (Tex. 2024).
- Argued and prevailed before the Texas Third Court of Appeals on a dispute involving the interpretation of Texas’s expunction statute and its interplay with the Texas Penal Code. Tex. Dep’t of Pub. Safety v. D.M.S., 681 S.W.3d 794, 796 (Tex. App.—Austin 2023, no pet.).
- Representing a natural gas storage company and its executives before the Texas Fourteenth Court of Appeals in a breach of contract and breach of fiduciary duty dispute.
