Alston & Bird represented client AliveCor against Apple in an inter partes review proceeding before the Patent Trial and Appeal Board (PTAB). In a significant victory for AliveCor, the PTAB found 19 claims of an Apple patent were invalid in a Final Written Decision. The subject patent, U.S. Patent No. 10,866,619 (’619 patent), relates to a biometric sensing system in an electronic device and was asserted against AliveCor in a case pending in the Northern District of California (Apple Inc. v. Alivecor Inc., No. 4:22-cv-07608 N.D. Cal.).
