A new era for noncompetes? Over the course of the past year, the federal government has taken unprecedented action in an effort to limit employers’ ability to use noncompete agreements to protect their businesses. The Federal Trade Commission recently proposed a ban on noncompete covenants, and Congress reintroduced legislation to prohibit the use and enforcement of noncompete agreements. Relatedly, the Department of Justice is actively pursuing criminal enforcement of “no-poach” agreements and wage information sharing between companies that arguably restrict worker mobility.
