Patrick Gennardo will be moderating and Bo Phillips, Tiffany Powers, Tom Evans, and Samuel Park will be speaking on the panel “The Evolution of COI Litigation: Changing Theories and Impactful Developments in Recent Years” at the ALIC 2021 Fall Annual Meeting.
The panel will address:
- The continuing evolution and expansion of cost of insurance litigation over the last three years
- The impact of recent federal appellate rulings and the issues raised by an increasing number of claims predicated on allegations that insurers used unauthorized factors in the initial setting of COI rates
- The different approaches taken in structuring settlements
- The application of contract theories developed in COI cases to challenge the periodic setting of interest credits and other nonguaranteed elements in insurance and annuity contracts
