Patent litigation is a business reality for companies big and small. Most companies are considering both how they might monetize their patents and how to defend against the same strategies from their competitors and from non-practicing entities (NPEs, which are affectionately known as patent trolls). The International Trade Commission (ITC) in Washington, D.C. plays an interesting role in these strategies, and the U.S. Patent Office now offers new ways to review and potentially invalidate a patent after it is granted, which is an enticing alternative to litigation. Alston & Bird's patent litigators hosted a fun and lively panel discussion on these subjects in three parts:
